These Terms & Conditions govern your access to and use of digital products, tools and services provided by Kobus Tollig Productions, including Ceremony Time and Wedding Day Flow.
By purchasing, accessing or using one of these products, you agree to these Terms & Conditions.
1. About our digital products
Ceremony Time and Wedding Day Flow are digital wedding planning tools created by Kobus Tollig Productions using experience gained from more than 500 real weddings.
Ceremony Time is designed to help couples identify a suitable ceremony time based on information such as wedding date, location, sunset time and the information entered by the user.
Wedding Day Flow is an interactive wedding timeline tool designed to help couples structure the flow of their wedding day and, where selected, surrounding wedding events.
These products provide guidance and recommendations. They do not replace a professional wedding planner, venue coordinator or other wedding professional.
2. One-time purchases
Unless specifically stated otherwise at checkout, Ceremony Time and Wedding Day Flow are sold as one-time digital purchases and are not subscriptions.
There are no automatic recurring charges associated with these products unless a future product is specifically described as a subscription before purchase.
The price applicable to your purchase is the price displayed to you before completing checkout.
3. Payment through Paddle
Payments for our digital products may be processed by Paddle.com.
Paddle acts as the Merchant of Record for transactions processed through its checkout and is responsible for processing payments, collecting applicable taxes, issuing transaction receipts and providing payment-related support.
Your transaction with Paddle is also subject to Paddle's Buyer Terms and applicable policies.
Kobus Tollig Productions remains responsible for providing and supporting the digital product itself.
4. Product access
After successful payment, you will receive access to the digital product you purchased.
You are responsible for providing a correct email address and any other information required to provide access.
Where an access code, private link or login credential is provided, it is intended for the purchaser's personal use.
You must take reasonable steps to keep your access information secure.
5. Personal-use licence
Your purchase gives you a limited, non-exclusive, non-transferable right to use the purchased product for your own personal wedding planning purposes.
You may not:
Resell the product or access to it
Share purchased access publicly or with unrelated third parties
Copy or reproduce the product for commercial use
Distribute templates, content, calculations or functionality from the product
Create a competing product using our content, structure, wording or proprietary functionality
Reverse engineer, extract or reproduce substantial parts of the software or underlying product
Remove ownership or branding information for the purpose of representing the product as your own
You may naturally share your completed wedding timeline with people involved in your wedding, including your partner, wedding planner, venue and wedding suppliers.
6. Accuracy of information
Our products generate recommendations using the information you provide.
You are responsible for ensuring that information entered into the product is accurate, including your:
Wedding date
Wedding location
Venue information
Travel times
Ceremony details
Photography or videography requirements
Event durations
Other wedding-day information
Incorrect information may result in an incorrect or unsuitable recommendation.
7. Sunset and timing calculations
Sunset times and other timing calculations are provided to assist with wedding-day planning.
Actual conditions may differ because of factors including:
Weather
Mountains or surrounding terrain
Buildings or physical obstructions
Seasonal conditions
Venue layout
Traffic or travel delays
Changes to the wedding programme
Delays involving guests or suppliers
Local conditions outside our control
A calculated sunset time or recommended ceremony time therefore does not guarantee specific lighting, weather or photographic conditions.
8. Wedding Day Flow recommendations
Wedding Day Flow provides suggested timing and structure based on the information entered and wedding experience incorporated into the product.
These recommendations are intended as guidance.
Every wedding is different, and you remain responsible for deciding whether the resulting timeline is appropriate for your wedding, venue, suppliers, guests and circumstances.
We recommend confirming important timings with the relevant venue and wedding suppliers before the wedding.
9. No guarantee of a particular wedding outcome
Kobus Tollig Productions does not guarantee that using Ceremony Time or Wedding Day Flow will result in a particular wedding-day experience, photographic result, schedule, weather condition or outcome.
Many aspects of a wedding are outside the control of a digital planning tool.
Our products are designed to help you make better-informed decisions, not to control or guarantee the events of your wedding day.
10. Saving and retaining your information
Where Wedding Day Flow allows you to save and return to your timeline, we will take reasonable steps to provide continued access to saved information.
However, users should keep their own copy of any final timeline or important wedding information.
We recommend downloading, printing or otherwise retaining a copy of your completed timeline.
11. Technical availability
We aim to keep our digital products available and functioning properly.
However, we cannot guarantee that the website or products will operate without interruption at all times.
Temporary interruptions may occur because of maintenance, internet outages, hosting providers, payment providers, third-party services, software updates or circumstances outside our reasonable control.
If you experience an access problem, please contact us and we will make reasonable efforts to restore access.
12. Refunds
Purchases are subject to our separate Refund Policy.
Because Ceremony Time and Wedding Day Flow are digital products made available after purchase, sales are generally final once access has been provided, except where applicable law or Paddle's policies require otherwise.
Personal dissatisfaction, change of mind or deciding after purchase that the product is not suitable for your individual preferences does not by itself create a right to a refund under our Refund Policy.
13. Intellectual property
Ceremony Time, Wedding Day Flow and their associated content, wording, design, calculations, structure, workflows, software, branding and original materials are owned by or licensed to Kobus Tollig Productions and are protected by applicable intellectual property laws.
Purchasing a product does not transfer ownership of the product or its intellectual property to you.
You receive only the personal-use rights described in these Terms.
14. Misuse and suspension of access
We may suspend or terminate access where we reasonably determine that a product is being:
Shared unlawfully
Resold
Copied for commercial purposes
Used fraudulently
Accessed using a fraudulent or reversed transaction
Used in a manner that infringes our intellectual property or the rights of another party
Where a transaction is refunded, reversed or successfully charged back, access to the associated product may also be cancelled.
15. Limitation of liability
To the fullest extent permitted by applicable law, Kobus Tollig Productions will not be responsible for indirect or consequential losses arising from the use of, or reliance on, Ceremony Time or Wedding Day Flow.
This includes losses resulting from wedding delays, supplier decisions, venue restrictions, weather, travel delays, changes to the wedding schedule or decisions made using recommendations generated by the products.
Where liability cannot legally be excluded, our liability will be limited to the extent permitted by applicable law.
Nothing in these Terms excludes or limits any mandatory consumer rights that cannot legally be excluded.
16. Privacy
Your use of our website and digital products is also subject to our Privacy Policy.
Our Privacy Policy explains how personal information is collected, used, stored and shared with service providers involved in operating our products.
17. Changes to our products
We may improve, update or modify Ceremony Time and Wedding Day Flow from time to time.
This may include design improvements, functionality changes, bug fixes or changes intended to improve the user experience.
Such updates do not create an entitlement to a refund where the essential product purchased remains available.
18. Changes to these Terms
We may update these Terms & Conditions from time to time.
The version published on our website at the time of use will be the current version.
Changes will not remove mandatory rights that already apply to a completed transaction.
19. Applicable rights
These Terms are provided by Kobus Tollig Productions, based in South Africa.
Nothing in these Terms is intended to exclude mandatory consumer protections that apply in the country or region where you live.
Transactions processed by Paddle are additionally governed by Paddle's Buyer Terms and any country-specific provisions contained in those terms.
